I have the honour to apply to
the
His Excellency
the Officer Administering the Government that I may be favoured with the opinion of
H. Stewart, the Acting Attorney General
on the following points.
1. Having regard to §§ VIII and XV of Ordinance 7 of 1862, has the Captain Superintendent of Police power to try a constable for an assault on a civilian?
2. Where an offence is punishable by law, but no particular sentence is defined by statute, can the Captain Superintendent deal with it under Ordinance 7 of 1862 as a breach of discipline?
I have to refer to Ordinance 8 of 1867 as defining the duties of the Police and Magistrates, and to Order 4 of 1865 § 1, and Order 16 of 1865 § VI, as to the punishment for breach of discipline.
3. The following are particulars of the case: Constables A and B, in plain clothes and wearing turbans, arrested C. A took C's turban and alleged that the price agreed upon was 60 cents, which C refused to give.
A struck C with the turban. Can the Captain Superintendent adjudicate in this case?
